Duramax Store, Inc. Settles For $62,250
In July 2021, the California Air Resources Board (CARB) reached a settlement with Duramax Store, Inc. (DMAX), located in Diamond Springs, California. The total penalty amount of $62,250 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
DMAX is a dealer selling light-duty diesel aftermarket parts. After a two-year investigation, the CARB staff determined that DMAX advertised, sold, and offered for sale various aftermarket air intakes, diesel exhaust fluid relocation kits, exhaust gas recirculation coolers, exhaust system kits, fuel pumps, manifold up pipes, tuners, turbochargers, turbo downpipes, and intercooler downpipes, without first acquiring legal exemptions to California anti-tampering laws. This conduct was in violation of California Vehicle Code sections 27156, 38391, and the California Code of Regulations, title 13, section 2222(b)(2). Such parts replace or modify vital original emission components and manufacturer-specified engine operating conditions and may cause increased vehicle emissions. As a result, aftermarket parts must be evaluated by CARB staff through the exemptions process to verify a vehicle’s continued emissions compliance. DMAX cooperated fully with CARB during the investigation, came into compliance, and established procedures to avoid this issue in the future.
