Chicks Produce, Inc. Case Settles for $1,000
In September 10, 2010, Chicks Produce, Inc. agreed to pay $1,000 penalties; $750 to the California Air Pollution Control Fund and $ 250 to the Peralta Community College District, for distribution to participating California Council on Diesel Education and Technology (CCDET) colleges. The settlement was reached during September 2010. The payments are completed as of September 10, 2010. The Chicks Produce, Inc. failed to provide Periodic Smoke Inspection Program (PSIP) data for year 2009 and to register their Transport Refrigeration Units (TRUs) in ARB Equipment and Registration (ARBER) system pursuant to Title 13 California Code of Regulations (CCR), Section 2180-2194 and CCR Section 2477, respectively. The case emphasizes the importance of the annual smoke inspections and timely registration in ARBER to demonstrate compliance.
