$10,800 in Fines Paid by BNSF Railway
Between April and October 2008, 26 Notices of Violation (NOVs) were issued to BNSF Railway for excessive locomotive idling. In addition, one NOV was issued for excess visible emissions. In December 2008, BNSF settled these violations by paying a penalty of $10,800. Earlier in the year, Union Pacific Railroad (UP) settled five NOVs issued during 2008 by paying $2,000 in penalties. Total railroad penalties received in 2008 is $12,800. The ARB/Railroad Statewide Agreement, also known as the “Railroad MOU,” provides for biannual inspections at most UP and BNSF Railway facilities in California. Staff identifies locomotives that are idling excessively, producing excess visible emissions, or using diesel fuel that does not meet standards. The entire SEIES unit assists with MOU inspections.
