AZ Off-Road & Performance, Inc. Case Settles for $10,000

On April 30, 2019, AZ Off-Road & Performance, Inc. (AZ Off-road), located in Phoenix, Arizona, settled with the California Air Resources Board (CARB) for violations of the aftermarket parts regulations.  AZ Off-road sold, offered for sale, and/or advertised aftermarket parts for use on highway and off-highway vehicles in California (hereinafter “Subject Parts”) that were not exempted by CARB pursuant to California Code of Regulations, title 13, section 2222 et seq. or California Code of Regulations, title 13, section 2472 et seq.  These Subject Parts altered or modified the original design or performance of the motor vehicle pollution control devices or systems. The advertisements, offers for sale, and sale of the Subject Parts were unlawful and violated the Vehicle Code sections 27156 and 38391 and California Code of Regulations, title 13, sections 2222 et seq. and 2471 et seq.  AZ Off-road has agreed not to install, sell, offer for sale, or advertise in California any aftermarket part in violation of the California regulations.  The company has agreed to pay a penalty of approximately $43 per violation, for a total of $10,000.  The per-unit penalty reflects the fact that AZ Off-road demonstrated financial hardship during the settlement negotiations.  AZ Off-road is now in compliance with the California regulation.
