Apothecary Products Case Settles for $400,000
On November 5, 2014, a case was settled with Apothecary Products Inc. for manufacturing and selling several wipe and liquid products used to clean eye glass lenses. Products of this type, when labeled exclusively to clean optical glass, are exempt from VOC limits under the “Glass Cleaner” product category in the Consumer Products regulation. However, Apothecary’s wipe products were also labeled with several additional cleaning claims, which placed the product in the “General Purpose Cleaner” product category, with a limit of 0.5 percent VOC. Enforcement Division staff calculated excess VOC emissions of 33.37 tons. The settlement agreement includes a payment of $400,000 to the California Air Pollution Control Fund with an additional $25,000 amount suspended for 12 months pending a reformulation attempt.
