Electra Cruises Settles Commercial Harbor Craft Violation for $137,500
Electra Cruises, paid $137,500 in penalties to the California Air Resources Board
(CARB), for violating the Commercial Harbor Craft Regulation. The violation was discovered during a routine inspection by CARB staff. This settlement was reached on May 30, 2019. An investigation by CARB showed that Electra Cruises had failed to meet the in-use standards as prescribed in the Commercial Harbor Craft Regulation, for a significant number of their engines. CARB alleged a total of 6 propulsion engines, and 2 generator engines found in violation, some for multiple years. The per unit penalty per year for propulsion engines amounted to $5,000.00 for 24 years total, and the per unit penalty for generator engines amounted to $2,500 for 7 years total.
Electra took prompt action after being notified of these violations and under CARB’s supervision, closely reviewed operational data. CARB approved the low-use compliance option for a number of their engines, and Electra Cruises invested heavily in the improvement of their shore-side electrification capabilities and brought their entire fleet into compliance with the Commercial Harbor Craft Regulation.
To settle the case, Electra Cruises agreed to the $137,500 penalty and to comply with CARB regulations. Under the terms of the settlement agreement, Electra Cruises agreed to fund the Kids Making Sense Youth Education, Southern California Supplemental Environmental Project. To this end, Electra Cruises paid $68,750 to the Coalition for Clean Air, and $68,750 to the Air Pollution Control Fund.
