Downey Wholesale Inc. Settlement
Downey Wholesale Incorporated Case Settles for $23,000
In February 2015, Downey Wholesale, Inc. agreed to pay $23,000.00 in penalties for violating air quality regulations: $17,250.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $5,750.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program.
An investigation by the Air Resources Board (ARB) showed that Downey Wholesale, Inc. (1) failed to comply with the Statewide Truck and Bus (STB) rule by neglecting to install legally required emission reduction devices by applicable compliance dates; (2) properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards; and (3) bring their Transport Refrigeration Unit (TRU) into compliance by the deadline set forth in the TRU Air Control Toxic Measure (ATCM). ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP), TRU and STB regulation.
To settle the case, Downey Wholesale, Inc. agreed to the $23,000.00 penalty and to comply with the PSIP, STB and TRU regulation and all applicable ARB regulations.
