Diamond Green Diesel LLC Settles For $168,000
In June 2022, the California Air Resources Board (CARB) reached a settlement with Diamond Green Diesel LLC (Diamond Green), with its principal location in Norco, Louisiana, in the amount of $168,000, for the company’s violation of CARB’s air quality regulations.
During an out-of-State inspection, CARB staff discovered that Diamond Green misrepresented the lifecycle carbon intensity of fuel produced in Louisiana and imported to California. Subsequently, Diamond Green and agents thereof submitted quarterly fuel reports that deviated from the actual carbon intensity of the fuel reported. CARB documented violations as they related to the Low Carbon Fuel Standards (LCFS) (Cal. Code Regs., tit. 17, § 95494 et seq.).
To settle the case, Diamond Green agreed to the penalty of $5,000 for each of the four (4) incomplete or inaccurate pathway application submittals, and $4,000 for each of the thirty-seven (37) incomplete or inaccurate quarterly reports, for a total of $168,000. The $168,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
Diamond Green has fully cooperated with CARB in the resolution of this matter and has worked with its partners to retire 20,181 credits erroneously generated. Diamond Green and its partners are now in compliance with the LCFS Regulation.
