Destiny Freight, Inc. Case Settles for $6,600
Destiny Freight, Inc. will pay $6,600.00 in penalties for violating air quality regulations: $4,950.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $1,650.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in August 2016.
An investigation by the Air Resources Board (ARB) showed that Destiny Freight Inc. failed to: (1) bring two of their Transport Refrigeration Units (TRU) into compliance with the applicable in-use performance standards, (2) meet the Phase-In Compliance Schedule as required by the Truck and Bus (TB) regulation. ARB documented violations as they related to the TRU Airborne Toxic Control Measure and the TB regulation. To settle the case, Destiny Freight, Inc. agreed to the $6,600.00 penalty and to comply with the TRU, TB and other ARB programs.
