Delta Excavating, Inc. Case Settles for $6,500
In April 2015, Delta Excavating, Inc. agreed to pay $6,500.00 in penalties for violating air quality regulations: $4,875.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $1,625.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program.
An investigation by the Air Resources Board (ARB) showed that Delta Excavating, Inc. failed to notify ARB within 30 days after selling the vehicles, as required by California Code of Regulations, title 13, section 2449(g)(4). ARB documented violations as they related to the In-Use Off-Road Diesel Vehicle Regulation (ORE). To settle the case, Delta Excavating, Inc. agreed to the $6,500.00 penalty and to comply with the ORE program.
