Dels Distributing Company Case Settles for $4,500.00
On March 22, 2012, Dels Distributing Company (DDC) agreed to pay $9,750.00 in penalties for violating air quality regulations. However, on April 26, 2012, DDC informed the Air Resources Board (ARB) that their electrical standby Transport Refrigeration Units (TRUs) did not get credited as an alternative technology because DDC had entered their TRU fleet information into the ARBER database incorrectly. The ARB Enforcement Division conducted a site visit and confirmed DDC TRU status as electric standby.
Based on this finding, DDC was refunded $5,250.00 on June 21, 2012, and their final penalty was adjusted to $4,500.00. The penalty was paid to the California Air Pollution Control Fund.
The ARB investigation of DDC was initiated when an informer identified the company as a violator of the TRU regulation. Based on the information provided during the investigation, it was determined that DDC failed to comply with the PSIP and TRU regulation. To settle the case, DDC agreed to the $4,500.00 penalty and to comply with the PSIP and TRU regulation.
