Del Monte Fresh Produce N.A., Inc. Settles Shore Power Case for $1,990,650
In August 2020, the California Air Resources Board (CARB) settled a case with Del Monte Fresh Produce N.A., Inc. (Del Monte) of Coral Gables, Florida for violations of the Ocean-Going Vessel At‑Berth Regulation for $1,990,650. A total of 4,383 violations were discovered during routine audits of Del Monte’s 2015 through 2019 Port of Hueneme fleet visits. The investigation by CARB revealed that in 2015 and 2016, Del Monte’s Hueneme fleet did not meet the operational time limits for at least 50 percent of its visits and did not reduce its auxiliary engine power generation by 50 percent, resulting in 1,601 violations. For compliance years 2017 through 2019, Del Monte’s Hueneme fleet did not meet the operational time limits for at least 70 percent of its visits and did not reduce its auxiliary engine power generation by 70 percent, resulting in 2,782 violations. To settle this case, Del Monte agreed to the $1,990,650 penalty. The per unit penalty was $454 per violation, although that average figure was not necessarily the basis upon which the parties have resolved this matter. Del Monte has also agreed to provide half of the total penalty toward a Supplemental Environmental Project (SEP). $995,325 will be paid to the Marine Vessel Speed Reduction Incentive Program Phase 2 SEP (Ventura County). The project will use the money to implement a vessel speed reduction program in and around the Santa Barbara Channel to reduce offshore nitrogen oxides, diesel particulate matter, sulfur oxides, and greenhouse gas emissions.
