Cummins West Inc. Case Settles for $24,000
Cummins West Inc. paid $24,000 in penalties for violating air quality regulations, $18,000 went to the California Air Pollution Control Fund and $6,000 to the Peralta Community College District for distribution to participating California Council on Diesel Education and Technology (CCDET) colleges. This settlement was reached in March 2010. An investigation by the Air Resources Board (ARB) showed that Cummins West Inc. failed to comply with California Vehicle Code (VC) Section 27156 and Title 13 CCR Sections 2706 (a)&(q) of the Verification Procedure by installing non-verified Diesel Emission Control Strategy (DECS) devices in California. To settle the case, Cummins West Inc. agreed to the $24,000 penalty and to comply with VC Section 27156, the Verification Procedure and the applicable Executive Orders. Cummins West Inc. also agreed to corrective actions requiring replacement of non-verified DECS with currently verified DECS.
