Cummins Power Generation Case Settles for $5,600
In January 2010, the ARB reached a settlement with Cummins Power Generation (Cummins) that included a $5,600 penalty to the California Air Pollution Fund for selling generators sets without submitting the required performance tests in their certification application. An investigation by the ARB showed that between January 1, 2008 and October 22, 2009, Cummins offered for sale generator sets which have a certified engine as “dual fuel engine capable of operating on both natural gas (NG), and Liquefied Petroleum Gas (LPG).” All the Production Line Tests (PLT) were completed on NG engines. Likewise, the certification application submitted to CARB only had NG performance data when instead LPG data should have been used. To settle the case and bring resolution to the matter, Cummins agreed to the $5,600 penalty.
