Cummins, Inc. Settlement
In February of 2020, Cummins, Inc. (Cummins), headquartered in Columbus, Indiana, settled its case with the California Air Resources Board (CARB) involving Diesel Particulate Filters (DPF). Cummins was offering for sale and selling remanufactured DPFs that did not meet the definitions of 13 CCR 2222. Upon further investigation Cummins informed CARB that it had a proprietary cleaning procedure that would clean DPFs to be functionally identical to a new DPF. CARB takes no position as to whether a remanufactured DPF is in fact functionally identical. However, per the settlement, Cummins has agreed to specified terms and conditions with regard to its proprietary cleaning procedure and handling of tracking.
