Cummins Emission Solutions and John Matthey, Inc. Case Settles for $110,000 plus $132,000 in Remediation
Cummins Emission Solutions & Johnson Matthey Inc. paid $110,000 in penalties for violating air quality regulations; $82,500 went to the California Air Pollution Control Fund and $27,500 to the Peralta Community College District for distribution to participating California Council on Diesel Education and Technology (CCDET) colleges. This settlement was reached in August 2010.
An investigation by the Air Resources Board (ARB) showed that between 2003 and 2009, Cummins Emission Solutions (CES) and its California distributors installed incorrect labels on Johnson Matthey Inc. Diesel Emission Control Strategy (DECS) devices. The labels are in violation of the Title13, California Code of Regulations sections 2706 (j) & (q) and Vehicle Code section 27156 because they incorrectly identify CES as the manufacturer. Johnson Matthey Inc., as the DECS manufacturer and verification holder, failed to ensure that CES installed the correct labels and therefore shares responsibility. To settle the case, Cummins Emission Solutions & Johnson Matthey Inc. agreed to the $110,000 penalty and to comply with VC section 27156, the Verification Procedure (Title 13 CCR section 2706) and the applicable Executive Orders. Cummins Emission Solutions & Johnson Matthey Inc. also spent approximately $132,000 in remediation by replacing all the incorrect labels with correct ones.
