CJBBB, Inc., dba Phoenix Boats Settles For $324,000
In May 2024, the California Air Resources Board (CARB) reached a settlement with CJBBB, Inc., dba Phoenix Boats, with its principal location in Winchester, Tennessee. Prior to receiving a CARB Executive Order, CJBBB, Inc. sold a total of 60 noncompliant vessels into California in violation of CARB’s Evaporative Emissions Requirements for Spark-Ignition Marine Watercraft with Gasoline-Fueled Engines Regulation (SIMW Evaporative Regulation), as codified in California Code of Regulations, title 13, sections 2850-2869).
To settle the case, CJBBB, Inc. agreed to the penalty of $5,400 per noncompliant vessel for a total penalty amount of $324,000. The civil penalty amount of $162,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The remaining amount of $162,000 will fund the Supplemental Environmental Project (SEP) entitled Reforestation of Native Trees in Sacramento County. This SEP will fund the planting of and care for 500 native trees for three years along the Toby Johnson and Franklin Channel in Elk Gove, California.
Terms of the settlement include a requirement for CJBBB, Inc. to comply with all CARB regulations going forward. CJBBB, Inc. cooperated with CARB to resolve this matter.
