Chong's Produce, Inc. Case Settles for $14,675
Chong’s Produce, Inc. will pay $14,675.00 in penalties for violating air quality regulations: $11,006.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $3,669.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in December 2015.
An investigation by the Air Resources Board (ARB) showed that Chong’s Produce, Inc. failed to: (1) bring their diesel fueled Transport Refrigeration Units (TRU) into compliance with the applicable in-use performance standards; (2) meet diesel particulate matter best available control technology requirements for on-road diesel fueled vehicles; (3) failed to report all required information for an on-road diesel fueled vehicle subject to the Truck and Bus (TB) Regulation; (4) misreporting required information for an on-road diesel fueled vehicle subject to the TB Regulation; and (5) properly self-inspect their diesel fueled trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP), the TRU Regulation and, TB Regulation. To settle the case, Chong’s Produce, Inc. agreed to the $14,675.00 penalty and to comply with PSIP, TRU, TB, and other ARB programs.
