BMW of North America Case Settles for $92,000
BMW contacted the Air Resources Board (ARB) and reported selling 23, model year 2012, motorcycles prior to receiving an ARB Executive Order (EO). When the error was identified by BMW, they issued a stop sale both internally and to all affected California dealers. No recall is needed in this case because confirmatory testing was completed, and an EO was recently approved that covers the affected motorcycle engine family. BMW violated Health and Safety Code sections (HSC) 43151-43153, i.e., selling non-certified vehicles. ARB negotiated a case settlement with BMW for a total of $92,000. This settlement takes into consideration that BMW self-reported the violations, was proactive and cooperative throughout the enforcement process, took corrective action to prevent future violations, and does not have a history of violations.
