Arkalon Ethanol, LLC Settles For $95,000
In October 2026, the California Air Resources Board (CARB) reached a settlement with Arkalon Ethanol, LLC (Arkalon), with its principal location in Liberal, Kansas, for the company’s violation of the Low Carbon Fuel Standard Regulation (LCFS Regulation), as codified in California Code of Regulations, title 17, section 95494 et seq.
Each fuel pathway holder must submit an Annual Fuel Pathway Report to CARB. Upon review of Arkalon’s submitted report, CARB staff discovered that the company’s operational carbon intensity for reporting year 2022 exceeded its certified carbon intensity. CARB documented the violations as they related to the LCFS Regulation. To settle the case, Arkalon agreed to the penalty of $95,000. This will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California’s air quality.
Terms of the settlement include a requirement for Arkalon to comply with all other CARB regulations going forward. Arkalon worked cooperatively with CARB staff to quickly resolve this matter, and worked with its partners to retire credits erroneously generated as a result of reporting fuels with inaccurate carbon intensity. Arkalon is now in compliance with CARB’s LCFS Regulation.
