Acuario USA Corp. Settles For $99,000
In May 2025, the California Air Resources Board (CARB) reached a settlement with Acuario USA Corp. (Acuario), with its principal location in El Paso, Texas, for the company’s violation of the Regulation for Reducing the Ozone Formed from Aerosol Coating Product Emissions (Aerosol Coating Regulation), as codified in the California Code of Regulations, title 17, section 94520 et seq.
An investigation by CARB Enforcement staff revealed that Acuario sold, supplied, offered for sale and/or manufactured for use in California, aerosol coating products that exceeded the reactivity limits specified in the Aerosol Coating Regulation (Cal. Code Regs., tit. 17, § 94522, subd. (a)). In addition, Acuario sold, supplied, offered for sale and/or manufactured for use in California, aerosol coating products that did not display the required labeling for aerosol coating products, as specified in the Aerosol Coating Regulation (Cal. Code Regs., tit. 17, § 94524). To settle the case, Acuario agreed to a penalty of $99,000 for 456 days of excess reactivity emissions and 6 days of administrative violations. This penalty takes into consideration the company’s proof of financial hardship.
Acuario fully cooperated with CARB to resolve this matter and ceased sales of the noncompliant product in California. The full penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
