Active Recycling Company, Inc. Case Settles for $21,000
In February 2012, Active Recycling agreed to pay $21,000.00 in penalties for violating air quality regulations: $15,750.00 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $5,250.00 will go to Peralta Community College District to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program.
An investigation by the Air Resources Board (ARB) showed that Active Recycling failed to comply with the Solid Waste Collection Vehicle (SWCV) rule by neglecting to install legally required emission reduction devices by applicable compliance dates. Active Recycling failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. Active Recycling failed to properly affix emission control labels (ECL) on the engines of their fleet vehicles. Active Recycling also failed to register with ARB and label their off-road vehicles. ARB documented violations as they related to the SWCV rule, Periodic Smoke Inspection Program (PSIP), ECL program, and In-Use Off-Road Diesel Vehicle Regulation. To settle the case, Active Recycling agreed to the $21,000.00 penalty and to comply with the PSIP, ECL, SWCV and In-Use Off-Road Diesel Vehicle regulations and other ARB programs.
