At Berth Regulation Innovative Concept Applications

The Innovative Concepts section of the At Berth Regulation, Section 93130.17, sets forth a compliance option to provide a vessel operator, terminal operator, or port a way to incorporate an innovative concept to reduce emissions from vessels or other sources in and around the port at a level comparable to what would be achieved with reducing emissions from vessels.
CARB received 12 applications for Innovative Concepts by the due date of December 1, 2021. The deadline for Innovative Concept Applications has passed, and CARB is no longer accepting applications. The table below lists the 12 applicants and their applications. Many of the submitted applications contained multiple “sub” concepts to be used together to meet the requirements of the At Berth Regulation which resulted in a total of 63 proposed concepts. CARB staff, during their initial evaluation, identified missing components from all applications. CARB’s correspondences to each applicant can be found at the table below.
The At Berth Regulation requires a 45-day public comment period. The 45-day public comment period has closed for all applications and the public comments that were received for each application are linked in the below table under the column labeled “Public Comment Dockets.” After the public comment period, the applicants were required to respond to all public comments within 45 days. The applicants’ innovative concepts, CARB staff’s letter and the applicants’ responses to public comments can be found by clicking on the applicants’ name in the table below. The public review and applicant response process was included in the Regulation to allow the public an opportunity to engage in a dialogue and be included in the process for Innovative Concept approval.
