Trimac Transportation Inc. Case Settles for $25,050
Trimac Transportation Inc. will pay $33,400.00 in penalties for violating air quality regulations: $25,050.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $8,350.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in May 27, 2016.
In November 2015, Enforcement Division initiated an investigation of Trimac Transportation Inc. as a result of Trimac Transportation Inc. meeting the criteria of the Smart Audit process. The investigation revealed that Trimac Transportation Inc. had failed to: (1) failed to meet PM BACT requirements for all 2005 through 2006 engine model years by January 1, 2014; (2) failed to include the Disclosure of Regulation Applicability on the bill of sales, contract addendums, or invoices, in violation of the Truck and Bus Regulation; and (3) failed to verify compliance for each vehicle hired or dispatched and to maintain records as required by the Truck and Bus Regulation and failed to verify dispatch trucks that are not compliant with the emissions standards set forth in the Truck and Bus Regulation. ARB documented violations as they related to the Truck and Bus Regulation.
To settle the case, Trimac Transportation Inc. has agreed to the $33,400.00 penalty and to comply with the Truck and Bus regulation and other ARB applicable regulations.
