Tesoro Refining & Marketing Company LLC Case Settles for $1,014,000
In November 2009, Tesoro Refining & Marketing Company LLC sold, offered for sale, supplied, or offered for supply California gasoline which had a sulfur content exceeding its Predictive Model limit(s) at/from its Wilmington Refinery. In May 2010, Tesoro sold, offered for sale, supplied, or offered for supply California gasoline which had a total aromatics content exceeding its Predictive Model limit(s) at/from its Martinez Refinery. And, in November and December 2010, Tesoro sold, offered for sale, supplied, or offered for supply California gasoline which had an olefin content exceeding its Predictive Model limit(s) at/from its Martinez Refinery. Finally, in November 2011, Tesoro combined conventional gasoline with CARBOB at Kinder Morgan’s Concord Terminal. In total, these violations extended over a period of 52 days. In December 2014, Tesoro paid a penalty of $1,014,000 to settle these violations, $760,500 going to the Air Pollution Control Fund and $253,500 to the San Joaquin Valley School Bus retrofit Supplemental Environmental Project to fund the retrofits of California school buses with diesel particulate filters. The penalty reflects the consideration of a number of circumstances, including: the violations were innocent and inadvertent, the fact that Tesoro made diligent efforts to comply, to reduce the number of days of violation, to cooperate with the investigation and to take steps to help prevent recurrence of similar situations.
