Matsubu Construction, Inc. Case Settles for $412.50
In June 2011, Matsubu Construction Inc. agreed to pay $412.50 in penalties for violating air quality regulations; $309.37 went to the California Air Pollution Control Fund and $103.13 to the Peralta Community College District.
Matsubu Construction Inc. failed to report and label all of the off-road vehicles in their fleet. Matsubu Construction Inc. is classified as a small fleet under the In-Use Off-Road Diesel Vehicle (ORDV) regulation and therefore, all of their off-road diesel vehicles needed to be reported to the Air Resources Board (ARB) by August 1, 2009 as set forth by 13 CCR Section 2449(g)(1). Matsubu Construction Inc. also failed to maintain PSIP records for some of their on-road diesel vehicles as set forth by 13 CCR Section 2192. Matsubu Construction Inc. has now reported and labeled their off-road fleet and opacity tested their on-road fleet and agreed to pay the $412.50 penalty and to comply with the off-road rule and all applicable ARB regulations.
