Yamaha Motor Corporation U.S.A. Case Settles for $36,000.00
In November 2010, Yamaha Motor Corporation, U.S.A. (Yamaha) disclosed to the Air Resources Board (ARB) that it unintentionally mislabeled 96 of its all terrain vehicles (ATVs) that were ultimately sold in California. Upon investigation by ARB, those labels were determined to be in violation of the emission control labeling provisions applicable to off-highway recreational vehicles and engines. Specifically, the subject violations involved the listing of incorrect manufacture dates and model year designations for various ATV engine families and models. To resolve the matter, Yamaha agreed to pay $36,000 in penalties to the California Air Pollution Control Fund in connection with those violations.
Yamaha promptly and fully cooperated with ARB in the investigation, and the case was settled in March 2013. The penalty total for those 96 ATVs was applied at a rate of $375 per unit.
