E&M ESR Inc. and CVS Pharmacy, Inc. Case Settles for $14,000
On June 17, 2015, a Consumer Products case was settled with the distributor, E&M ESR Inc., and CVS Pharmacy Inc., for selling and/or supplying diverted, non-compliant Hair Mouse that had been intended for sale in Europe. This case is CVS Pharmacy’s second violation of the Consumer Products Regulation for selling diverted products within the last five years. The sale of the non-complying Hair Mousse contributed to 84.6 pounds of excess Volatile Organic Compound (VOC) emissions due to exceeding the 6% by weight VOC limit set under Consumer Products Regulation for the category specified in Title 17, CCR, section 94509(a). E&M ESR Inc, paid $14,000.00 to settle this case.
