Automotive Transmission Specialist, Inc. Case Settles for $110,500
In September 2015, the Air Resources Board (ARB) reached a settlement with Automotive Transmission Specialist, Inc., DBA ATS Diesel Performance (ATS) that included $110,500 in penalties for violating air quality regulations: $82,875 to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $27,625 to the School Bus and Diesel Emission Reduction Supplemental Environmental Project which primarily assists school districts with funding to ensure protection of children’s health while continuing home-to-school transportation, assists compliance with the In-Use Truck and Bus Regulation, and results in emission reduction benefits.
A routine investigation by ARB revealed that ATS sold, offered for sale, and/or advertised, aftermarket performance parts that were not exempted from California’s anti-tampering laws. Such performance parts replace or affect vital original emission components and thus must be evaluated by ARB to demonstrate continued emissions compliance. ATS took immediate corrective action and implemented additional compliance procedures, including applying to ARB and receiving Executive Orders. While ATS’s actions did not retroactively exempt the aftermarket performance parts, ATS’s actions demonstrate its commitment to environmental compliance. ATS has agreed not to install, sell, offer for sale, or advertise in California any aftermarket part in violation of the California Code of Regulations, title 13, section 2220 et seq. or Vehicle Code section 27156.
