Husqvarna Professional Products, Inc. Case Settles for $1,150
In April 2019, Husqvarna Professional Products, Inc. (Husqvarna), located in Charlotte, North Carolina, settled its case with the California Air Resources Board (CARB) for labeling violations related to the sale of mislabeled Small Off-Road Engines. Forty-six Husqvarna MZ Zero-Turn Mowers were sold in California with an incorrect evaporative emissions family label. This conduct was in violation of the “Evaporative Emission Requirements for Off-Road Equipment” Regulation (California Code of Regulations, title 13, section 2750 et seq.), which was adopted to reduce emissions of oxides of nitrogen and hydrocarbons from off-road spark-ignited engines rated at equal to or less than 19 kilowatts, and equipment utilizing such engines.
Husqvarna voluntarily disclosed the violation to CARB within 21 days of discovery and fully cooperated with CARB during the agency’s investigation. Husqvarna agreed to pay a $25 per unit penalty resulting in a total civil penalty of $1,150 to the Air Pollution Control Fund. Husqvarna agrees that it will not introduce products into commerce in California unless the units are properly labeled.
