Las Montanas Market Settles For $30,000
In November 2023, the California Air Resources Board (CARB) and Las Montanas Market reached a settlement for the company’s violations of the regulation for the Management of High Global Warming Potential Refrigerants for Stationary Sources (RMP Regulation), as codified in the California Code of Regulations, title 17, section 95380 et seq.
Las Montanas Market, with its principal location in San Pablo, California, is a grocery store that operates large-sized refrigeration systems having a full charge of greater than 2,000 pounds of refrigerant.
In 2020, Las Montanas Market was referred by the Research Division to the Enforcement Division for late reporting, late annual implementation fee payment, and lack of leak inspection records as specified in California Code of Regulations, title 17, section 95386(a). CARB’s investigation identified and documented the company’s failure to submit annual reports and failure to pay annual implementation fees in 2021.
The civil penalty of $30,000 is approximately $5,000 per unit. The total penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
