In August 2023, the California Air Resources Board (CARB) and Paradise Valley Market, Inc., dba Carnival Market, (Paradise Valley Market), reached a settlement for the company’s violations of the regulation for the Management of High Global Warming Potential Refrigerants for Stationary Sources (RMP Regulation) as codified in the California Code of Regulations, title 17, section 95380 et seq.
Paradise Valley Market, with its principal location in Chula Vista, California, is a grocery store that operates medium-sized refrigeration systems having a full charge of greater than 200 and less than 2,000 pounds of refrigerant. Paradise Valley Market is subject to the requirements of the RMP Regulation because it self-reported that it owns and operates stationary refrigeration systems.
In 2021, Paradise Valley Market was referred by the Research Division to the Enforcement Division for late reporting, late annual implementation fee payment, and lack of leak inspection records as specified in California Code of Regulations, title 17, section 95386(a). CARB’s investigation identified and documented the company’s failure to submit Annual Reports, failure to pay Annual Implementation Fees and failure to preform quarterly leak inspections in 2020 and 2021. Paradise Valley Market also failed to provide records when asked by a CARB representative at time of inspection on August 18, 2021.
