Commonwealth Wholesale Corp. Settles For $6,200
In March 2023, the California Air Resources Board (CARB) and Commonwealth Wholesale Corp. (CWC), with its principal location in Hallandale Beach, Florida, reached a settlement for CWC’s violation of the Consumer Products Regulation to reduce volatile organic compounds (VOCs) in the California Code of Regulations, title 17, section 94507 et seq.
An investigation by CARB staff revealed that CWC sold, supplied, and offered for sale in California, hair finishing and hair shine products that were not compliant with the Consumer Products Regulations. The Batiste Stylist Oomph My Locks XXL Volume Spray products and the Garnier Fructis Triple Nutrition Miraculous Oil-In- products contained concentrations of VOCs that exceeded the standards specified in the California Code of Regulations, title 17, section 94512(a). The violation of 0.37 tons of excess VOC emissions in the Hair Finishing Spray and Hair Shine categories over a period of one year resulted in a penalty of $6,200.
CWC fully cooperated with CARB to resolve this matter. The total penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. CWC has implemented a procedure whereby products intended to be distributed for sale in California have documentation confirming they are compliant with the State’s Consumer Products Regulation.
