Rust-Oleum Corporation Settles For $10,000
In June 2022, the California Air Resources Board (CARB) reached a settlement with Rust-Oleum Corporation (Rust-Oleum), with its principal location in Vernon Hills, Illinois, in the amount of $10,000, for the company’s violation of CARB’s air quality regulations.
CARB staff conducted an investigation that revealed Rust-Oleum sold, supplied, offered for sale and/or manufactured: (1) A mist spray adhesive product for use in California containing concentrations of volatile organic compounds (VOC) that exceeded the standards specified in California Code of Regulations, title 17, section 94509(a); and (2) A clear coating product for use in California that exceeded the allowable reactivity limit specified in California Code of Regulations, title 17, section 94522(a). The mist spray adhesive product was also missing the adhesive labeling requirements as specified in California Code of Regulations, title 17, section 94512(d). In addition, Rust-Oleum failed to meet the date of manufacture requirements as stated in California Code of Regulations, title 17, section 94512(c)(1). The penalty in this case is for excess VOC, labeling violation, and 0.2 tons of excess reactivity emissions.
To come into compliance, Rust-Oleum is no longer offering the mist spray adhesive for sale in California and will modify the clear coating product to meet regulatory requirements for commerce in California. Rust-Oleum cooperated fully with CARB to resolve this matter. The $10,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California’s air quality.
