Brush And Pencil, LLC Settles For $1,500
In November 2021, the California Air Resources Board (CARB) and Brush And Pencil, LLC (Brush And Pencil), of Porter, Texas, agreed to a penalty in the amount of $1,500 to settle violations of CARB’s air quality regulations. The $1,500 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
An inspection by CARB staff revealed Brush And Pencil sold, supplied, offered for sale and/or manufactured an aerosol coating product for use in California, which did not display the applicable category code and reactivity limit on the product container, which is a violation of the Aerosol Coating Regulation (Cal. Code Regs., tit.17, §§ 94520 et seq.). To comply, Brush And Pencil will add the category code and reactivity limit to all future production of the product. The company fully cooperated with CARB to resolve this matter.
