Mitsubishi Engine North America Case Settles for $20,625
In July 2016, Mitsubishi Engine North America (Mitsubishi) agreed to pay $20,625.00 in penalties to the California Air Pollution Control Fund for violating air quality regulations. An investigation by the Air Resources Board (ARB) showed that Mitsubishi failed to report 55 off-road compression-ignition engines to ARB pursuant to California Code of Regulations, title 13, section 2423 (d)(7) and incorrectly labeled these engines to indicate that they “COMPL[Y] WITH CALIFORNIA EMISSION REQUIREMENTS UNDER 13 CCR 2423(d).” in 2011-2013. There is no indication that the engines were delivered to California. To settle the case, Mitsubishi agreed to the $20,625.00 penalty and that it will not sell, offer for sale, advertise, or label for introduction into commerce into California any new off-road compression-ignition engine in violation of California Code of Regulations, title 13, section 2423 et seq. This settlement takes into consideration that Mitsubishi discovered the violations during a self-audit, subsequently self-reported, no units were sold to California customers, and because Mitsubishi was cooperative throughout the enforcement process.
