Expedited BARCT

The expedited best available retrofit control technology (BARCT) requirements of AB 617 are an important component of the bill, which is intended to provide benefits to residents statewide that are living near industrial sources. In addition to the statewide benefits of expedited BARCT, the schedules are expected to yield important emissions reduction benefits in disadvantaged communities.
Districts in nonattainment for one or more air pollutants are required to adopt an expedited schedule by January 1, 2019 for the implementation of BARCT by December 31, 2023. The expedited BARCT schedules apply to each industrial source that as of January 1, 2017, was subject to the Cap-and-Trade program. This requirement addresses sources that fall within 18 air districts across the state. The adopted schedules must give highest priority to permitted units that have not modified emissions-related permit conditions for the greatest period of time. In developing the expedited schedules for implementing BARCT, affected air districts must prioritize the retrofit of emissions sources that have not been addressed for the longest period of time to promptly reduce emissions in communities located near these sources. The schedule does not apply to emissions units that have implemented BARCT due to a permit revision or new permit issuance since 2007.

2The district has reviewed all rules that apply at AB 617 industrial facilities and have determined that the rules are currently at BARCT stringency.
3The district is currently evaluating two potential areas for rule development. The evaluation process will be completed by 2021, and any identified rules will have a compliance data no later than December 31, 2023.
4 After a preliminary review of all rules that apply at AB 617 industrial facilities, the district has committed to evaluating the rules identified to determine if they are at BARCT stringency. If the rule is determined to not be at BARCT stringency, the district will adopt a revision to the rule by the anticipated District rule adoption date listed.
5 Status of rules as of 4/2022. The following definitions apply: "Complete" - Rule adopted by Board; "TBD" - Not adopted, but rulemaking status unknown; "In Progress" - Draft rulemaking documents in-development and may be publicly available; "Evaluation" - Rule is undergoing internal review to evaluate potential controls, emissions benefits, etc. Data/information may not be publicly available; "Removed" - Removed from district schedule.
6 The affected facility incorporated all BARCT requirements directly into the facility’s operating permit. A rule proceeding was no longer necessary since BARCT-level controls will be required through the permit process. Please see the district's BARCT analysis for more details.
