Torrance Logistics Company LLC Settles California Reformulated Gasoline Violation for $18,000
In March 2020, Torrance Logistics Company LLC (TLC) settled a case with the California Air Resources Board (CARB) for $18,000.00 in penalties, for violating the California Reformulated Gasoline (CaRFG) Regulations as codified in California Code of Regulations (CCR), title 13, § 2250-2273.5 et seq. (13 CCR § 2250-2273.5).
TLC self-disclosed the violation to CARB in July 2016. The CaRFG Regulations require gasoline to meet a minimum concentration of additives at the time of transaction. An estimated 3.7 million gallons of gasoline failed to meet this requirement. Furthermore, the noncompliant gasoline was delivered to various retail stations over the course of six days.
TLC agreed to pay a total of $18,000 for under-additizing the gasoline and for selling, offering for sale, supplying, offering for supply, or transporting the gasoline (per count penalty of $1,500). Factors that influenced this penalty included the immediate voluntary disclosure of this violation, that this was TLC’s first violation, diligent efforts were made to comply, and immediate action was taken to mitigate this violation.
As a preventative effort, TLC counseled its operators to check the additive names on a daily basis and the injection rates posted in the terminal office for operators to reference.
