Terminal Plans

What are Terminal Plans?

A terminal plan is a planning document that must be submitted to CARB by regulated marine terminal operators discussing how a regulated terminal intends to comply with the requirements of the Regulation. The requirements for a terminal plan are found in Section 93130.14(a) of the At Berth Regulation. 

Ports may submit terminal plans for their terminal operators if they choose.

When were they due?

All terminal plans were due on December 1, 2021.

Which terminals are required to submit a terminal plan?

All terminals receiving 20 or more visits from a regulated vessel category must submit a terminal plan, and all ports with regulated terminals must submit a port plan. All port and terminal plans must be signed by the applicable port’s and terminal’s Responsible Official under penalty of perjury and are subject to verification by CARB staff.

What is required to be included?

Terminal plans must include a list of any anticipated necessary infrastructure modifications needed to reduce emissions from ocean-going vessels at a terminal by the required implementation dates for the vessel category(s) received by that terminal.

For each emissions reduction strategy that the terminal intends to use for compliance, the terminal plan must include the requirements specified in Section 93130.14 of the At Berth Regulation. 

All terminal plans shall be signed by the applicable terminal’s Responsible Official under penalty of perjury and are subject to verification by CARB staff. The division of responsibilities between the terminal operator and the port must be signed by the port’s Responsible Official under penalty of perjury.

Can I provide a public and not-public components of Terminal Plans to address potential confidential business information?

Terminal Plans (Plans) will be posted to CARB’s website for public review for transparency. The Plans can include both public and confidential information. CARB is requesting that if the Plan includes confidential information, the Plan is submitted in two parts, where Part 1 contains only public information. Any confidential information is submitted in Part 2, under the cover of and per the directions contained in the Confidentiality Form for the Plans.

Will CARB provide a template to use for terminal plan submittals?

CARB staff will not provide a template. We will leave the submittals at the individual terminal discretion to decide what format works best for them to provide to CARB.

Terminal plans can be submitted to CARB through e-mail to shorepower@arb.ca.gov or physical mail, as specified in Section 93130.19 of the At Berth Regulation.
