SMS Supercars Case Settles for $28,000
In September 2011, the ARB reached a settlement with SMS Supercars that included a $28,000 penalty to the California Air Pollution Fund for marketing and selling modified engines in California without receiving an ARB Executive Order.
An investigation by the ARB showed that between August 30, 2010 and February 28, 2011, SMS Supercars marketed and offered for sale to various auto dealers in California a supercharger kit that would modify and increase the original equipment manufacturer performance specifications for new MY2010 Dodge Challengers (under 7,500 odometer miles) for use or registration in California. Marketing and offering for sale the supercharger kit without a valid Executive Order render the vehicles uncertified and illegal for sale in California and are in violation of Health and Safety Code sections 43151 through 43153. The case settled in September 2011, for Twenty Eight Thousand Dollars ($28,000).
