Scepter Manufacturing, LLC Case Settles for $10,872

Scepter USA (Scepter), located in Miami, Oklahoma, is a manufacturer of portable fuel containers and its associated spouts. Scepter designed and began production of a new spout for its containers before obtaining an ARB Executive Order which certifies them as meeting the performance standards defined in California regulation. The new spouts were legal for sale in most other states before obtaining California certification, but some of the production inadvertently leaked into the California marketplace. Upon discovery, Scepter immediately withdrew the uncertified product from store shelves and disclosed the incident of non-compliance to ARB. 

Scepter USA provided ARB with all needed information during the agency’s investigation and fully cooperated in the resolution of this matter. The penalty provision applied for the sale of the uncertified product in this case is Health and Safety Code section 43017. The case was settled in June 2014 for a penalty of $10,872.00.
