Onyx Enterprises Int’l, Corp. Settles For $281,000
In July of 2020, Onyx Enterprises Int’l, Corp. (Onyx), headquartered in Cranbury, New Jersey, settled its case with the California Air Resources Board (CARB) for emissions violations related to the sale of non-exempted add-on or modified vehicle parts in California. Onyx operates several auto parts websites: www.carid.com, www.truckid.com, www.powersportsid.com, and www.motorcycleid.com. CARB determined that Onyx advertised, sold, and offered for sale, add-on or modified vehicle parts without legal exemptions to California’s anti-tampering laws. Such parts replace or modify vital original emission components and manufacturer specified engine-operating conditions, and thus must be evaluated by CARB to demonstrate the vehicle’s continued emissions compliance. This conduct was in violation of California Vehicle Code section 27156 and 38391, and California Code of Regulations, title 13, sections 2220 et seq. and 2470 et seq.
The resulting settlement requires the company to pay a $250 per unit penalty resulting in a total penalty of $281,000. Onyx has agreed to provide half of the total penalty toward a Supplemental Environmental Project. $140,500 will be paid to the Installation of School Air Filtration Systems – El Centro (Imperial County). The project will use this money to install and maintain high-performance air filtration systems in schools located in communities impacted by air pollution.
Onyx has agreed not to install, sell, offer for sale, or advertise in California any aftermarket part in violation of Vehicle Code sections 27156 and 38391, and California Code of Regulations, title 13, sections 2220 et seq. and 2470 et seq.
