Nunez Transport Case Settles for $32,250.00
In August 2013, Victor Manuel Nunez DBA Nunez Transport paid $32,250.00 in penalties for violating air quality regulations: $24,187.50 went to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $8,062.50 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program.
An investigation by the Air Resources Board (ARB) showed that Victor Manuel Nunez DBA Nunez Transport failed to bring its fleet in compliance with the applicable in-use performance standards provided for in the Statewide Truck and Bus (STB) regulation and the Transport Refrigeration Unit (TRU) Airborne Toxic Control Measure (ATCM) and failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP), STB regulation, and TRU ATCM. To settle the case, Victor Manuel Nunez DBA Nunez Transport agreed to the $32,250.00 penalty and to comply with the PSIP, STB, TRU and other ARB programs.
