RotopaX Legacy LLC Settles For $117,000
In June 2025, the California Air Resources Board (CARB) reached a settlement with RotopaX Legacy LLC (RotopaX), a portable fuel container manufacturer located in Woods Cross, Utah, for violations related to CARB’s Fuel Containers and Spill-Proof Spouts Regulation (Portable Fuel Container Regulation), as codified in California Code of Regulations, title 13, sections 2467 et seq.
CARB conducted compliance testing of RotopaX portable fuel container systems (PFCs) that were certified under CARB Executive Order G-11-044D. CARB alleges the PFCs failed to meet the diurnal performance specification of RotopaX’s certification requirements.
To settle the case, RotopaX agreed to the penalty of approximately $5.32 per unit of noncompliant PFCs for a total penalty of $117,000. RotopaX elected to provide $58,500 to a Supplemental Environmental Project (SEP) entitled Building the Roots to our Movement: Advancing Urban Canopy in Eastside San Jose Through Community Leadership Model, with Latinos United for a New America (LUNA). The SEP proposes planting 1,000 trees on a 4-year timeline on the East Side of San Jose, expanding the urban tree canopy from 12% to 30%.
The civil penalty amount of $58,500 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. RotopaX fully cooperated with CARB to resolve this matter and agrees to comply with all regulatory requirements.
