Rock Creek Solid Waste Facility Settles For $37,326
In June 2024, the California Air Resources Board (CARB) reached a settlement with Rock Creek Solid Waste Facility (Rock Creek), with its principal location in Farmington, California for violating CARB’s Methane Emissions from Municipal Solid Waste Landfills (LMR) regulation, as codified in the California Code of Regulations, title 17, section 95460 et seq.
An investigation conducted by CARB staff showed that Rock Creek failed to comply with LMR: “the gas control device must be operated within the parameter ranges established during the initial or most recent source test” (Cal. Code. Regs., tit. 17, § 95464(b)(2)(A)(4)). To settle the case, Rock Creek agreed to the penalty of $1,756.56 per day for a total of $37,326.
Rock Creek fully cooperated with CARB to resolve this matter. Of the total amount, $18,663 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The remaining amount of $18,663 will fund the Supplemental Environment Project (SEP) entitled Residential Air Filtration Program with San Joaquin Valley Air Pollution Control District. This SEP provides free in-home air filtration units to residents in the Valley to improve indoor air quality. Terms of the settlement include a requirement for Rock Creek to comply with all other CARB regulations going forward.
