Boston Whaler, Inc. Settles For $30,000
In May 2024, the California Air Resources Board (CARB) reached a settlement with Boston Whaler, Inc., with its principal location in Edgewater, Florida, for the company’s violation of the Evaporative Emissions Requirements for Spark-Ignition Marine Watercraft with Gasoline-Fueled Engines Regulation (SIMW Evaporative Regulation), under California Code of Regulations, title 13, sections 2850-2869.
Boston Whaler, Inc. discovered and voluntarily disclosed potential violations to CARB. CARB’s subsequent investigation confirmed and documented that Boston Whaler, Inc. manufactured for sale, sold, and introduced into commerce in California new Spark-Ignition Marine Watercraft (SIMW) that had not received a CARB Executive Order and were therefore noncompliant.
To settle the case, Boston Whaler, Inc. agreed to the per unit penalty of $1,500 per violation for a total settlement of $30,000. Of this amount, the civil penalty amount of $19,260 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The remaining amount of $10,739 will fund a Supplemental Environmental Project in Bay View Hunters Point in East/West Oakland and the Contra Costa County region entitled, New Voices are Rising: Air Quality Week.
Terms of the settlement include a requirement that Boston Whaler, Inc. comply with all CARB air quality regulations going forward. Boston Whaler, Inc. fully cooperated with CARB to resolve this matter.
