Perkins Engines Company Limited, LLC Settles For $410,625
In March 2024, the California Air Resources Board (CARB) reached a settlement with Perkins Engines Company Limited (Perkins), an off-road compression ignition (CI) engine manufacturer located in the United Kingdom, in the amount of $410,625 for violations related to CARB’s Off-Road Compression-Ignition Engines and Equipment Regulation (Off-Road CI Regulation), as codified in the California Code of Regulations, title 13, sections 2420–2427.
The settlement resolves a self-disclosure by Perkins that IHI Agri-Tech Corporation (IAT), while in negotiations with Perkins for the sale of the IAT engine business to Perkins, including a license to the intellectual property rights for those engines, certified, manufactured for sale, sold, offered for sale, introduced or delivered for introduction into commerce, or imported into California, model year 2018 and 2019 off-road CI engines, that failed to comply with the requirements of the Off-Road CI Regulation by failing to meet the emission standards (Cal. Code Regs., tit. 13, § 2423), resulting in 219 violations. Perkins obtained a license to the intellectual property relating to the model year 2018 and 2019 engines and undertook to validate the engineering data provided by IAT for all transitioning engine families. This analysis resulted in Perkins' identification of and disclosure of the issue. To settle the case, Perkins agreed to the penalty of $1,875 per noncompliant engine for a total penalty of $410,625.
Of the total amount, $205,313 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The remaining amount of $205,312 will fund the Supplemental Environment Project (SEP) entitled, “To Reduce Contaminated Waste & Emissions Throughout Bay View Hunters Point Community” in San Francisco, California. SEP funds will be used to support the Bayview Hunters Point Environmental Justice Response Task Force, a community-led task force, where a wide range of pollution issues are raised and examined at monthly meetings. Perkins fully cooperated with CARB to resolve this matter and agrees to comply with all regulatory requirements.
