BakeMark USA LLC Settles For $58,000
In February 2024, the California Air Resources Board (CARB) reached a settlement with BakeMark USA LLC, a Delaware limited liability company, with its principal place of business in Pico Rivera, California, for violations of the regulation, Management of High-Global Warming Potential Refrigerants for Stationary Sources (Refrigerant Management Program or RMP Regulation), as codified in California Code of Regulations, title 17, section 95380 et seq.
BakeMark USA LLC failed to: (1) Pay annual implementation fees on time; (2) Conduct leak detection and monitoring once every three months; and (3) Submit annual reports on time, as required by the RMP Regulation.
The settlement amount of $58,000 in civil penalty represents a penalty of approximately $1,500 per unit for each unit of failure to pay the annual implementation fee on time and failure to submit the annual report on time; and approximately $4,000 per unit for each outstanding leak inspection and monitoring record. The full settlement amount will be deposited into CARB’s Air Pollution Control Fund, which funds projects and research to improve California’s air quality.
