La Plaza Market LLC Settles For $6,000
In November 2023, the California Air Resources Board (CARB) and La Plaza Market LLC (La Plaza Market) reached a settlement for the company’s violations of the regulation for the Management of High Global Warming Potential Refrigerants for Stationary Sources (RMP Regulation), under California Code of Regulations, title 17, section 95380 et seq., and the regulation for Prohibitions on Use of Certain Hydrofluorocarbons in Stationary Refrigeration, Stationary Air-Conditioning, and Other End-Uses (HFC Regulation), under California Code of Regulations, title 17, section 95371 et seq.
In 2020, La Plaza Market was referred to the Enforcement Division by the Research Division for the company’s failure to update the refrigeration system information in the Refrigerant Registration and Reporting System (R3), and failure to submit annual reports and implementation fees for reporting years 2017-2021. CARB’s investigation identified and documented the company’s failure to report refrigeration systems accurately, failure to submit annual reports on time, and failure to pay annual implementation fees on time, as required by the RMP Regulation. La Plaza Market also failed to submit annual reports on time as required by the HFC Regulation.
The civil penalty of $6,000 represents a per unit penalty of $1,500 per violation under the RMP and HFC Regulations. The penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
