Hyundai America Technical Center, Inc. Settles For $4,341,750
In November 2023, the California Air Resources Board (CARB) reached a mutual settlement with Hyundai America Technical Center, Inc. (HATCI), acting on behalf of itself and its affiliates Hyundai Motor America and Kia America, Inc., formerly known as Kia Motors America, Inc., for HATCI’s violation of California’s light-duty vehicle regulations, as specified in the California Code of Regulations, title 13, sections 1961(d) and 1961.2(d).
Specifically, the settlement was the result of HATCI voluntarily disclosing to CARB in December 2020 that it failed to submit for approval the details of emission-related changes that were made to many Hyundai and Kia vehicles certified between model years 2017 and 2021.
The total penalty of $4,341,750 is based on HATCI’s disclosure of the violations in accordance with CARB’s 2020 guidance mail-out that allowed such disclosures to be eligible for significantly reduced penalties if made before the end of 2020. Of the total settlement amount, $2,170,875 will be deposited into CARB’s Air Pollution Control Fund to provide funding for projects and research to improve California's air quality. The remaining amount of $2,170,875 will fund the Supplemental Environment Project (SEP) entitled, “Community Based Monitoring and Assessment Program for Fresno Phase 2.” This SEP provides extensive air pollution monitoring in the Fresno, California region over a four-year period to assist local communities with determining the need for appropriate pollution control actions.
